South Korea's top court on Wednesday rejected a proposal by the United States government to allow South Korea to import more generic Viagra.
South Korea's Supreme Court heard arguments on Wednesday afternoon and decided that South Korean citizens could now get a medicine to cure erectile dysfunction in South Korea, where the country has strict health and safety rules.
The ruling, by Judge Noh Nen Min, had already been in effect since at least May 2014, when he was named as the country's first US judge.
South Korea has a long history of patent expiry, which means that the country can now manufacture and sell a variety of generic products at a lower price than the US market, including Viagra and other similar drugs.
The ruling, by the United States Justice Department, has been made up of two main parts: the ruling that makes the medicine more expensive than the US market, and the lower court's decision to decide the matter.
The court's ruling on the medicine is part of an effort by South Korean President Park Geun-Hye to avoid a "surprise" with the US, which had been expected to be given the green light to manufacture a generic version of the drug.
Park, a Korean-American who has been the country's most visible figure, had said he would take an anti-impotence drug if he could afford to buy it, which he said was too expensive and too risky for a small country.
He was also under investigation by South Korea's Food and Drug Administration over his use of the medicine.
"In South Korea, you have a lot of people who are in need of medicine and they are worried about their health," Park said.
The FDA had been asked by the US Food and Drug Administration to comment on the issue, but had not given a ruling on the matter.
On Wednesday, the FDA said it was investigating whether the government's efforts were anticompetitive in that it could introduce a drug that is cheaper than the US market, and that the drug could also be used in South Korea.
While South Korean citizens could now get a medicine to cure erectile dysfunction in South Korea, the US could not. The US is the country's largest purchaser of generic Viagra.
Park, who has a family history of diabetes, was first to launch a medical treatment for diabetes in the country.
He has said he wants to improve the quality of life for the millions of South Korean men he has encountered in the past.
"I have always been a good friend of the people," Park said, speaking from a deep voice.
Park's family has been involved in drug-selling, advertising and marketing for the drug since he was a child.
Park has said he has taken the medicine to treat his chronic kidney disease, an ailment that is often exacerbated by diabetes. He has also been prescribed a "heart drug" or "blood drug" for diabetes, and has said he does not know why it is prescribed to him.
Park is a retired teacher who lives in Seoul and is the chairman of an advisory board for a Korean pharmaceutical company.
Park's medical history includes diabetes, hypertension and smoking, and he was prescribed two kinds of medicines to treat his high blood pressure and angina.
In addition, he has been prescribed Viagra, a drug that has been approved by the US Food and Drug Administration to treat erectile dysfunction, for the treatment of pulmonary arterial hypertension.
